Terms & Conditions
These terms and conditions are the contract between You and The Roofing Merchant (“us,” “we” etc.) By visiting or using Our website, you agree to be bound by them.
Interpretation
The following definitions and interpretation apply in these conditions.
Our, Us, or We: Stoneleaf Building Materials Limited T/A The Roofing Merchant, (Referred to as ‘The Roofing Merchant’ in this document). A company registered in England & Wales with company registration number 03877699 and whose registered office is at 146 New London Road, Chelmsford, Essex CM2 0AW.
You, or Your: anyone who uses our website
Consumer or Customer: You the individual placing orders, if Your Order or acceptance of Our quotation is not for the purposes of Your trade, business or profession.
Contract: the contract between You and Us for the sale and purchase of Goods which is formed when We accept Your final Order or when You accept our quotation, incorporating these conditions (the “Conditions”). When we communicate with you we do so by email. You agree that email communications are contractually binding in the same way as properly signed and dated paper sent by post.
Delivery Point: the place where delivery of Goods is to take place.
Goods: any goods that We agree in the Contract to supply to You (including any part or parts of them).
Order: Your order for Goods from Us.
1. Acceptance of your Order and Payment
1.1 Your Order is an offer to buy from us. Nothing we do or say will amount to any acceptance of that offer until we actually dispatch the Goods to you. [ At any point until then, we may decline to supply the Goods to you without giving any reason]
1.2 We must receive payment for the whole order including delivery for the required goods prior to the order being accepted. Once the order has been paid for in full we will confirm receipt of the order via email to the address provided. A further email will be sent to inform that the order has been dispatched. Only at this point has the order been accepted.
1.3 All orders are subject to acceptance by The Roofing Merchant and the availability of products. If the goods ordered are not available in the expected time scale, we will aim to inform the customer as soon as we are aware or delays.
1.4 The Roofing Merchant reserve the right to refuse any order, at which point any monies paid will be refunded.
1.5 We take care to make Our Website safe for you to use. Card payment are not processed through pages controlled by us. We use a online payment service provider who will encrypt you card or bank account details in a secure environment. .
1.6 If you asked us to remember your credit card details in readiness for your next purchase, these details will be encrypted and stored securely and only used to process payments which you have initiated.
2. Price
2.1 All current prices are displayed on the individual product pages and apply to the specific product variant only. Product variants, sizes, and colours are changed and selected using the drop-down menus. Products with more than one option/variant will display the lowest priced item within a product range and are only applicable to the specific, lowest priced item.
2.2 All prices include Value Added Tax (VAT), unless otherwise stated, at the current UK tax rate. The price inclusive and exclusive of VAT will be clearly displayed on invoices. VAT invoices will be emailed to the customer once the order has been accepted and Paid.
2.3 We retain the right to amend all prices including delivery charges at any time. Additional charges or price increases must be paid in full prior to delivery.
2.4 All products are subject to manufacturers price increases and additional charges set by the manufacturers. In the event of a manufacturer applying additional charges the costs must be paid in full by the customer prior to delivery.
2.5 All products are subject to delivery charges. Delivery charges vary depending on the material ordered and cannot be refunded. The delivery charge will be added during the checkout stage of the order process. By clicking ‘Checkout’ the customer accepts the delivery charge and agrees to the terms for which this charge cannot be refunded.
3. Deliveries
3.1 Delivery charges and estimated delivery times are applicable to UK mainland only. We are unable to ship to any address or port outside UK mainland.
3.2 The goods will be delivered to the address given by the customer at the checkout stage of the order. It is the customers duty to ensure this address is correct before completing any order. Any additional charge for correcting a delivery to an incorrectly stated address will be payable by the customer.
3.3 We aim to complete orders within the estimated time scales stated when placing orders. Estimated time scales are not guaranteed delivery times and are subject to change by factors outside of our control. The Roofing Merchant shall not be liable for any delay caused in the delivery of goods. Signing “Unchecked”, “ Not checked” or similar is NOT acceptable
3.4 In the case of products purchased by credit card, the products can only be dispatched to the credit card holder's delivery address. All products must be signed for on delivery.
3.5 If the customer is unable or unwilling to accept the delivery on the agreed date, the customer will be liable to pay for any re-delivery charges, handling charges and storage charges that are likely to be applied.
3.6 It is the customers responsibility to inform The Roofing Merchant of any access restrictions for site deliveries. Site deliveries can be made on large articulated lorries and therefore The Roofing Merchant must be notified if the access is not suitable. Any costs for re-delivery and restocking charges must be paid by the customer in the event a delivery cannot be carried out due to the limited access.
3.7 Palletised deliveries via a tail lift vehicle are strictly curb side and the drop point is determined by the delivery driver. In some incidents the pallets may be dropped in a driveway. The destination of any delivery is at the driver’s discretion. Pallet Deliveries cannot be made on gravel or grass driveways. It is the customers responsibility to inform The Roofing Merchant if a driveway or delivery point is not a hard surface. Any costs for non-deliveries due to unsuitable surfaces must be paid by the customer.
3.8 Any damages must be recorded at the delivery point. This can be done by clearly marking the delivery paperwork when the delivery is being made. The damages must be reported to The Roofing Merchant within 12 hours of the delivery. No claims for damages will be accepted if delivery notes are not signed for as damaged. Any images must be forwarded to sales@roofingmerchant.co.uk
3.9 If your goods have been damaged in transit, you must refuse the delivery and immediately contact us, so that we may dispatch a replacement quickly and minimiser your inconvenience
3.10 Goods must be checked on delivery and any shortages in quantity or missing items must be written on delivery notes and reported to The Roofing Merchant within 12 hours of delivery. No claims for shortages or missing items will be accepted if delivery notes are not signed for as short.
3.11 It is the customers responsibility to make allowance for ‘wastage’ when ordering building materials. A suggested 5% allowance should be applied to quantities to allow for small cosmetic issues with the goods or minor damages caused when handling the materials on site.
3.12 Installation is not included for any products sold via The Roofing Merchant.
4. Returns & Refunds
4.1 Under the Consumer Contracts Regulation 2013 customers may cancel within 14 days of placing an order. This must be made in writing to sales@roofingmerchant.co.uk If you amend or cancel an Order, Your liability to Us shall be limited to payment of all costs we have reasonably incurred in fulfilling the order up until the date we receive the amendment or cancellation.
4.2 In the event that the goods have been received before an order is cancelled the products must been returned to the point of dispatch at the customer’s own cost and risk. Restocking charges will apply.
4.3 Cancelled orders must not be unpacked and should be sent back in the same condition as they were received. Once The Roofing Merchant has been informed of the customer’s intention to return products, the goods must be received at the point of dispatch within 7 days.
4.4 All goods must be returned along with their original packaging and with sufficient protection to avoid damage occurring in transit. The customer is wholly responsible for the goods in transit and any damage. Goods must be sent by a recorded carrier service.
4.5 For cancelled orders where goods have been sent direct from a manufacturer, the return must be made to the manufacturers dispatch depot. Manufacturer’s may wish to carry out their own retrieval of cancelled orders. In these circumstances The Roofing Merchant will communicate specific returns procedures at the time the cancellation is communicated to The Roofing Merchant. All manufacturer’s charges, including re-stocking charges, handling charges and haulage charges must be paid in full by the customer. Each manufacturer has specific return policies, including non-return policies, which will apply to the customer’s orders.
4.6 If the customer believes an order or part of an order to be faulty, please do not return the item before contacting The Roofing Merchant to explain the problem. With regards to a fault, no full or part refunds or replacements can be issued without first establishing with The Roofing Merchant and the manufacturer that the fault lays with the product.
4.7 Once goods have been received by The Roofing Merchant in a resalable condition, refunds will be processed within 7 working days. Refunds on goods returned directly to manufacturers are subject to longer processing periods. Only once The Roofing Merchant have received confirmation of the refund from the manufacturer and any manufacturers charges deducted will the refund be processed
